ORDER CANCELLATION
Zofanso by Safemaxx Deliv can cancel any order at any time due to the food/product's unavailability, out-of-coverage area, and any other unavoidable circumstances.

Cancellation and Refund Policy:

Restaurant Partner hereby agrees that if it accepts the Order cancellation request raised by a Customer via the Zofanso App by Safemaxx Deliv Platform for Restaurant Partner, it shall not be eligible to receive any Order Value or amount for such cancelled Order.

If a User wants to cancel any confirmed order then he/she must cancel the order within the time frame of 5 Minutes after the order confirmation. Otherwise, he/she will be penalized a small amount of penalty in case the Order status goes into processing i.e. called under food waste.

You acknowledge that (1) your cancellation, or attempted cancellation of an order, or (2) cancellation due to reasons not attributable to Zofanso by Safemaxx Deliv, that is, in the event you provide incorrect particulars, contact number, delivery address, etc., or that you were unresponsive and/or not reachable or unavailable for the fulfilment of the services offered to you, shall amount to a breach of your unconditional and irrevocable authorization in favour of Zofanso by Safemaxx Deliv to place that order against the Restaurant Partners/Store(s) on your behalf (“Authorization Breach"). In such cases you commit an Authorization Breach, you shall be liable to pay the liquidated charges of an amount equivalent to the order value. You hereby authorize Safemaxx Deliv to deduct or collect the amount payable as liquidated damages through such means as Safemaxx Deliv may determine in its discretion, including without limitation, by deducting such amount from any payment made towards your next Order.

There may be cases where Zofanso by Safemaxx Deliv is either unable to accept your order or cancels the order, due to reasons including without limitation, technical errors, unavailability of the item(s) ordered, or any other reason attributable to Safemaxx Deliv, Restaurant Partner/Store or Delivery Partner. In such cases, Zofanso by Safemaxx Deliv shall not charge a cancellation charge from you. If the order is cancelled after payment has been charged and you are eligible for a refund of the order value or any part thereof, the said amount will be reversed to you.

No replacement/refund / or any other resolution will be provided without the Restaurant Partner’s/Store(s)’ permission in case the Order goes into processing and food gets prepared.

Any complaint, with respect to the order which shall include instances but not be limited to food spillage, foreign objects in food, delivery of the wrong order or food and beverages or Products, or poor quality, You will be required to share the proof of the same before any resolution can be provided.

You shall not be entitled to a refund in case instructions placed along with the order are not followed in the form and manner You had intended. Instructions are followed by the Restaurant Partner on a best-efforts basis.

All refunds shall be processed within 3 to 4 working days in the same manner as they are received unless refunds have been provided to You in the form of credits, refund amount will reflect in your account based on your respective bank policies. (Excluding Official Holidays)
DISCLAIMER
The platform may be under continuous upgrades, and some functions and features may not be fully available or operational to users as well as restaurant merchants, and delivery partners.
Zofanso by Safemaxx Deliv does not warrant that You will be able to use the Zofanso by Safemaxx Deliv Platform and/ or will be able to provide the Delivery Services at all times or locations on the Zofanso by Safemaxx Deliv Platform or that the Zofanso by Safemaxx Deliv Platform and the Platform Services will be uninterrupted or error-free or that the defects will be capable of being corrected by the Zofanso by Safemaxx Deliv in a timely routine. The Platform Services, Zofanso by Safemaxx Deliv Platform, Device, the output generated therefrom, and all other technologies developed by Zofanso by Safemaxx Deliv are provided to you on an “AS IS'' and “AS AVAILABLE” basis, and Zofanso by Safemaxx Deliv specifically disclaims all warranties and indemnities, express, implied or statutory, including without limitation any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, or any other warranty arising from the course of performance or course of dealing.
